Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of Phind (the "App"), operated by HUUH PTY LTD, a company based in Sydney, New South Wales, Australia. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the App. By registering, you represent that you meet these requirements and that all information you provide is accurate.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at contact@phind.com.au if you become aware of any unauthorised use of your account.

4. Acceptable use

When using the App, you agree not to:

• Provide false information or impersonate another person.
• Harass, threaten, or abuse other users.
• Use the App for commercial solicitation without our consent.
• Attempt to circumvent, disable, or interfere with security features of the App.
• Use the App for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms, including where a user is confirmed to have repeatedly failed to honour confirmed matches or events.

5. Meeting other users

Phind facilitates introductions between users around real-world events. We do not conduct criminal background checks on users. You are solely responsible for your interactions with other users, and we encourage you to take reasonable precautions when meeting anyone in person, including meeting in public places.

6. Ghost Town — consequence system

Phind operates a community accountability system called Ghost Town. If you confirm attendance at an event with a match and then ghost — meaning you cancel without reasonable explanation, stop responding within 24 hours of the event after receiving an in-app check-in, or fail to attend without prior notice — your match may file a report against you.

Reports are reviewed by Phind before any action is taken. You will be given an opportunity to respond to any report filed against you. Genuine emergencies and mutual cancellations will not result in any consequence.

If a report is confirmed, your account may be placed in Ghost Town — a restricted mode in which you can only match with other users who have been similarly restricted. You will be notified when your account is placed in Ghost Town and the reason for the restriction.

To exit Ghost Town you must pay the exit fee displayed within the App at the time of restriction. This fee is non-refundable. Multiple confirmed ghosting incidents may result in permanent account suspension without the option to exit via payment.

By creating an account on Phind you acknowledge and agree to this consequence system as a condition of use.

7. Subscriptions and payments

Certain features of the App may require a paid subscription. Prices are displayed in the App prior to purchase and are charged through the applicable app store. Billing, renewal, and cancellation are handled according to the policies of that app store.

8. Intellectual property

The App, including its name, branding, and underlying software, is owned by HUUH PTY LTD and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

9. Disclaimer and limitation of liability

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, HUUH PTY LTD is not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms excludes any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and any disputes arising from them are subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
